18 U.S.C. §§ 2257 and 2257A Compliance Statement

PantyBuyer.com is an adult-only online platform operated by PantyBuyer LLC (“PantyBuyer,” “we,” “us,” or “our”), a New Mexico limited liability company. This Statement explains PantyBuyer’s content standards and its age-verification and recordkeeping practices as they relate to 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75.

1. Content Standards and No Sexually Explicit Content

PantyBuyer is an adult-only platform that does not permit sexually explicit content. The recordkeeping requirements of 18 U.S.C. §§ 2257 and 2257A apply to depictions of sexually explicit conduct as defined in 18 U.S.C. § 2256(2), which includes actual or simulated sexual intercourse, masturbation, sadistic or masochistic abuse, bestiality, and lascivious exhibition of the anus, genitals, or pubic area. PantyBuyer prohibits all such content. At launch, sellers may post only images of themselves, including clothing, underwear, lingerie, or limited non-explicit adult nudity, and may not post depictions of sexual activity, exposed genitals or anus, lascivious exhibition of the genitals or pubic area, or any offer or arrangement of sexual activity. PantyBuyer is therefore not intended to host content that is subject to the recordkeeping requirements of 18 U.S.C. §§ 2257 and 2257A.

2. Age and Identity Verification as a Safeguard

Although PantyBuyer does not permit sexually explicit content, PantyBuyer verifies the age and identity of every seller before approval as a conservative safeguard. Before a seller account is approved, the seller must submit government-issued photo identification, which may include the front and back of an identification card or a passport, and an image of the seller holding the identification next to the seller’s face. PantyBuyer compares the information extracted from the identification, including by scanning the identification barcode where available, against the information the seller provides, and an authorized reviewer confirms the verification before the seller is approved. PantyBuyer converts and encrypts the verification records, stores the encrypted records in a restricted, private platform storage location, and deletes the temporary original upload file after processing.

4. Content Depicting Additional Persons

Content depicting any person other than the verified seller is prohibited at launch. PantyBuyer is developing a feature that would require any additional person to complete the same identity and age verification process before that person may appear in seller content. Until that feature is available and the additional person has completed and passed verification, sellers may not upload content depicting anyone other than themselves. If PantyBuyer enables content depicting additional persons, or if the platform’s content standards ever expand to permit content that is subject to 18 U.S.C. §§ 2257 or 2257A, PantyBuyer will implement the verification, recordkeeping, custodian, and cross-reference measures required for that content before such content is permitted.

5. Records, Custodian, and Inspection Readiness

PantyBuyer maintains its seller age-verification and identity records as electronic, encrypted records rather than as physical paper files. PantyBuyer does not currently produce, host, or maintain content that is subject to the recordkeeping requirements of 18 U.S.C. §§ 2257 and 2257A. To the extent any content is later determined to be subject to those requirements, or the content model expands as described in Section 4, the custodian of records for PantyBuyer LLC and the location of the records are as follows:

Custodian of Records: the individual designated by PantyBuyer LLC to serve in the role of Custodian of Records, in care of PantyBuyer LLC, 530-B Harkle Road, Ste. 100, Santa Fe, New Mexico 87505. Records are maintained electronically in encrypted platform storage and are not maintained as physical paper files.

6. Platform Review and Enforcement

PantyBuyer may request age-verification documentation, identity documentation, consent documentation, ownership documentation, or other compliance materials from any seller or user, and may refuse to publish, restrict, remove, disable access to, or preserve content when we believe the content may be non-compliant, unlawful, unauthorized, non-consensual, exploitative, or inconsistent with this Statement, the Terms of Service, or other platform policies. PantyBuyer reports apparent child sexual abuse material to the National Center for Missing & Exploited Children’s CyberTipline as required by law, and may report suspected trafficking, non-consensual content, coercion, fraud, or other unlawful conduct to law enforcement, payment processors, regulators, or other appropriate parties as required or permitted by law.

7. Notices Regarding Potentially Non-Compliant Content

Questions or notices regarding potentially non-compliant content should be sent to compliance@pantybuyer.com or submitted through the Content Removal & Complaint Policy. A notice should include, when available, the URL or unique content identifier for the content at issue, the username or account associated with the content, the reason the content is believed to be non-compliant, and sufficient contact information for follow-up. PantyBuyer may request additional information before taking action and may decline to act on notices that are incomplete, inaccurate, abusive, fraudulent, unsupported, or submitted in bad faith.

8. No Public Disclosure of Private Verification Records

Government identification images, seller verification records, private compliance notes, and other private compliance materials are not public profile content. PantyBuyer may maintain, review, preserve, or disclose such materials only as described in this Statement, the Terms of Service, the Privacy Policy, applicable platform policies, or as required or permitted by law.
