18 U.S.C. §§ 2257 / 2257A Record-Keeping Compliance Statement

PantyBuyer.com is an online marketplace and user-generated-content platform. Except for content expressly created, commissioned, purchased, selected, edited, materially altered, curated, or otherwise produced by PantyBuyer.com, PantyBuyer.com does not act as the primary producer of visual depictions made available through the website.

For purposes of this Statement, “Covered Content” means any visual depiction of an actual human being engaged in actual or simulated sexually explicit conduct, or any other visual depiction subject to the record-keeping requirements of 18 U.S.C. §§ 2257, 2257A, and 28 C.F.R. Part 75.

User-Generated and Third-Party Content

Content made available through PantyBuyer.com may be uploaded, posted, offered, sold, transmitted, or otherwise provided by independent users, sellers, performers, studios, advertisers, or third-party content providers.

PantyBuyer.com’s handling of user-generated or third-party content is generally limited to the transmission, storage, retrieval, hosting, formatting, display, or removal of material submitted by users or third-party providers. PantyBuyer.com’s removal, restriction, moderation, disabling of access, suspension of accounts, or enforcement of its Terms of Service, Acceptable Use Policy, or other platform policies shall not, by itself, constitute selection, alteration, creation, production, or assumption of responsibility for such content.

Each uploader, seller, performer, studio, advertiser, or third-party content provider is responsible, to the fullest extent permitted by law, for determining whether any content submitted, uploaded, posted, offered, sold, transmitted, or otherwise provided by that contributor constitutes Covered Content and for creating, maintaining, indexing, preserving, and producing all records required under 18 U.S.C. §§ 2257, 2257A, and 28 C.F.R. Part 75.

Contributor Representations and Warranties

By uploading, posting, offering, selling, transmitting, or otherwise providing content through PantyBuyer.com, each contributor represents, warrants, and covenants that:

1. every actual human being appearing in any Covered Content was at least eighteen (18) years old, and the age of majority in the applicable jurisdiction if higher, at the time the content was created;

2. the contributor has verified the legal identity and age of each performer appearing in Covered Content by reviewing valid government-issued photo identification or other legally sufficient identification;

3. all records required under 18 U.S.C. §§ 2257, 2257A, and 28 C.F.R. Part 75 have been created, maintained, indexed, cross-referenced, preserved, and made available as required by law;

4. the content does not depict, involve, promote, solicit, or facilitate minors, child sexual abuse material, coercion, force, fraud, trafficking, exploitation, non-consensual activity, revenge pornography, unlawful surveillance, or any other unlawful conduct;

5. the contributor has obtained all necessary rights, permissions, releases, consents, and authorizations from all persons depicted in the content;

6. the contributor will promptly provide legally required records, certifications, performer releases, consent documentation, identity-verification materials, or other compliance documentation upon lawful request or upon PantyBuyer.com’s good-faith platform compliance review; and

7. the contributor will immediately notify PantyBuyer.com if the contributor becomes aware that any content submitted through the website may be inaccurate, non-compliant, unauthorized, non-consensual, unlawful, or otherwise in violation of this Statement, the Terms of Service, or applicable platform policies.

Content for Which PantyBuyer.com Is Deemed a Producer

For any content for which PantyBuyer.com is legally deemed to be a producer required to maintain records under 18 U.S.C. §§ 2257, 2257A, or 28 C.F.R. Part 75, the required records are maintained by the designated Custodian of Records identified below.

Platform Compliance Rights

PantyBuyer.com reserves the right, in its sole discretion and without limiting any other rights or remedies, to request age-verification documentation, identity-verification documentation, 18 U.S.C. §§ 2257 / 2257A compliance certifications, performer releases, consent documentation, ownership documentation, or other compliance materials from any user, seller, performer, studio, advertiser, or third-party content provider.

PantyBuyer.com may restrict, geoblock, suspend, remove, disable access to, or refuse to publish any content that PantyBuyer.com believes may be non-compliant, unlawful, unauthorized, non-consensual, exploitative, misleading, or inconsistent with the website’s Terms of Service, Acceptable Use Policy, or other platform policies.

PantyBuyer.com may suspend or terminate accounts, preserve relevant information, cooperate with lawful requests, and report apparent child sexual exploitation, child sex trafficking involving a minor, non-consensual content, trafficking, coercion, or other unlawful conduct to NCMEC’s CyberTipline, law enforcement, payment processors, regulators, or other appropriate authorities as required or permitted by law.

PantyBuyer.com may request additional information before taking action and may decline to act on notices that are incomplete, inaccurate, abusive, fraudulent, or unsupported. Nothing in this Statement limits PantyBuyer.com’s right to remove content, restrict access, suspend accounts, preserve information, or report suspected unlawful activity in its sole discretion or as required or permitted by law.
